The diver that assumed the total liability to dive by his
own will, also assumed all of the liability for his own
safety, except where a license is issued. It is TOTALLY
irrelevant if and when any disclaimers are listed on a license,
because the primary claim relied on the offer made,Rulling Law,
when made, to access the licensed item so decribed, for profit.
Hence the issuer of the license is FULLY liable
for performance presentment, assuming ALL of the
unlisted liabilities therein. Who ever accepted a
license, is the secured party, under the license.
A good example is the charter boat responsibilities: the diver,
if injured, has recourse in law therein for recovery.
