Facinating, this issue has been kicked aroun for months now and is still treated with a remarkable degree of cultural insensitivity. U.S. Supreme Court decisions are what we use to wrap dead fish in when we run out of News Print here.

You are not in Kansas anymore. Canada is a soverine nation with it's own political and judicial system and relevent case law. Bill 13 will come or go as the case may be. In reality I suspect shipwreck management issues will be a concern for the next decade. The problem will be resolved, and the resolution will be Canadian. These means that even in the worst case senario the chances of having a SWAT team board your boat a shove a machine gun in your face (as it is apparently necessary to do when restoring a six year old to his father's care in the U.S.) enforcing shipwreck legistlation are rather remote.

I am amased that arguments, including case law, are continualy forwarded by people who want to be good Americans and enjoy all of there rights and freedoms in Canada. On the south side of the pond I am a guest and I play by the local rules. Noth side your a guess and guess what happens if you don't play by the local rules? Unhappy? you should have tried harder in the war of 1812.

: : Well no.

: : Both of you have not grasped what Bill 13 is about. The idea that this has anything to do with divers removing anything from shipwrecks is redeculous. It is a power struggle over control of a resource and that is about it.

: : Shipwrecks have always been National, in Canada, and that's the rub. From when Canada became Canada shipping, navigation and shipwrecks are part of the domain of the Federal Government, who, interestinly enough, protects the private property rights of the owners.

: : Tobby Barrett proposed Bill 13. Tobby Don't Dive! He has "Jason" Jason has a basic SCUBA card, and has actually dove on three shipwrecks! also has, a Job in Mr. Barrett's office and his first razor (he is still getting used to shaving and cuts himself up quite a bit).

: : So of course, with this great team of experts they sat down and spent an entire 11 days drafting Bill 13 which is unconstitutional so the Province can grab the resourse from the Feds.

: : When Last seen Mr. Barrett had his tail substantialy between his legs and has now engaged in a vain effort to modify his Bill in the hope that he can get enough support from the gullable in the diving comunity to save face.

: : Throw the Bum out!

: : : : The diver assets were (are being now) seized and nationalized. All divers are chattell goods. I said ALL divers are just cord-wood, to be used. They want to locate anyone diving, were required to be licensed, as shown by Bill-13. See Exhibit-4.
: : : : This is the seizure of the divers industry by means of licensing authority.
: : : : I further find that pursuant to case U.S. v. Butler (Supreme Court), 1935 (Exhibit-5) the Supreme Court was correct in striking down the above mentioned Act, are coercion contracts and at the gun point too. They are adhesion contracts made by a dictator, a superior over an inferior. They are under the belligerant capacity of government over enemies. They are not valid contracts. Their "Heritage" sedulously framed, could be broken down, the independence of the individual obliterated by the tirant, and the area under supervision converted into a central socialist government exercising uncontrolled police power throughout the region superseding all local controls over local concerns, including the red-coats clubs they have seduced with bribery. A few dollars here and there, and they have a following, to move this bill ahead, maybe. Some are watching, were is this going?
: : : : The "criminal intent" of the Bill-13, just like the copy cat of the Supreme Court case cited, they turned it down flat. The Supreme Court Justices said, in effect: "You're turning the (listed x x forces) into an uncontrolled police state, exercising uncontrolled police power." They further stated: "We further find in the first hundred days of the reign of Roosevelt (in U.S. v. Butler) (now Toby and his socialist party grave robbers) similar seizures by licensing authority were successfully completed and made, with only a couple hundred dead resistors in various sectors, and all natural resouces.
: : : : Why would it matter if your sister or brother died, at the hands of a socialist-community-ist, drunk on police power? Would burden others likewise, obliterate all remaining individuality of the subjects. The administrative agencies under the Classification Act, as amended, to fix the compensation of any officers and employees so appointed. (In other words, they have now, the insentive to collect, hunt divers, extort to the maximum, just to pay for the perpetuity of this Toby police state salary, with health and retirements benefits.)
: : : : All they need is just a slight approval for a Bill-13 passage, in any form, however truncated, but for how long?
: : : : A majority of the people have lived all of their lives under emergency rule. The "Toby Rule" may expand to all civilian other interests, if succesfull here first. If they can pull this stunt on the stupid SCUBA diver, where else can it merge?
: : : : They may add some broad powers to meet the emergency in some cases, expand later the same authority he had used for solving the wreck crisis. Now the "wreck" has a crisis.
: : : : Waco actions were taken under the War and Emergency Powwer Act of March 9, 1933, as expanded from and creating a presumption that their personal "Heritage Religion" was not standard, not school approved, 80 people died defending the faith, mostly children.

: My statement was meant for all shipwreck legislation in general. it is not needed, we can self regulate shipwreck diving within our own power but it's to late for that now, we will have to live with the inevetable goverment regulations in the future before certain groups yell for restrictions and prosecution of wreck divers get your facts straight ALL the facts.
