Steve, thanks for the thoughtful posts. I did indeed forget about the foreign flagged wrecks! The Cerisoles and Inkermann are also under this area. I disagree that embeddedness is as important of often claimed. For practical purposes, the meaning of these terms is up to the interpretation of any judge that the question comes before.
My analysis was meant not so much to look at the letter of the law, as to give an analysis of what is likely to happen. I do believe that the ASA has some serious problems in composition. It is somewhat self contradictory. I wish the lawmakers of the 1980s had the foresight to consider Great Lakes wrecks in framing this law.
This is one of my favorite topics to address. Thanks for your post. It's always great to hear from people with personal experience in these matters.
