The Hamilton & Scourge are currently classed as
protected sites and as such are not diveable.
Current fine under the Ontario Heritage Act is
$50,000.00 plus up to six months in jail.
Gary Gentile and others have been appling for
permission/permits to dive the sites for over six
years, but have always been refused.
Gary launched a law suit against the City of
Hamilton and thr Province of Ontario over a year
ago, has run up over $20,000 in legal fees and
still has not had his day in court.
Gary's suit challenges the Heritage Act. There
is now a Bill before Parliment, which if it
passes, will fill in the holes that Gary's
suit is challenging.
Hopefully the Bill fails. Gary's day in
court should happen early in the new year.
